2 States Drag FG To Supreme Court Over Alleged Illegal FAAC Deductions—-Two states under the control of the People’s Democratic Party (PDP), Adamawa and Oyo states, have taken legal action against the Federal Government at the Supreme Court, challenging alleged unauthorised deductions from the federation account.

Each state is seeking clarification on Section 162 (1), (2), and (3) of the Nigerian Constitution concerning revenue distribution.

In Suit Number SC/CV/547/2024, Oyo State, represented by Chief Bolaji Ayorinde SAN, is requesting the Supreme Court to prohibit the federal government from making any deductions from the federation account for projects or payments, other than those mandated by the constitution for revenue distribution among federal, state, and local governments.

Oyo State is also asking for a directive to ensure that funds credited to the state and its local government councils are distributed as required by Section 162(4) and (5) of the Constitution.

The suit includes several declarations, such as:
“It is unconstitutional for the federal government to deduct or charge any funds credited to Oyo State in the federation account for any alleged debts or agreements.

The federal government lacks the constitutional authority to manage funds credited to Oyo State in the federation account before revenue distribution.
Any unilateral deductions by the federal government from the amounts due to Oyo State are illegal and void.”

Oyo State’s filing, supported by a 35-paragraph affidavit from the Director of Treasury, Ayanniyi Taiwo Michael, emphasizes that all funds allocated to the state from the federation account should be distributed without deductions.

The affidavit asserts that Oyo State’s entitlement to these funds is constitutionally protected and should be free of any charges or encumbrances.

Similarly, the Adamawa State government is arguing that all funds in the federation account must be distributed to all levels of government without unauthorized deductions. The state stresses that the President must adhere strictly to constitutional provisions in managing and distributing revenue.

Adamawa State is seeking a Supreme Court declaration that any deductions or withholdings by the federal government lacking constitutional backing are unconstitutional. The state emphasizes that the federal government’s authority to manage revenue is limited to what is explicitly allowed by the constitution.

No hearing date has been set for these cases.

Former President Muhammadu Buhari is dead.

His former aide, Bashir Ahmad, announced the passing of the former president on X.

He wrote: “The family of the former president has announced the passing on of the former president, Muhammadu Buhari, GCFR, this afternoon in a clinic in London.

May Allah accept him in Aljannatul Firdaus. Amin.”

President Buhari, who served as Nigeria’s civilian president from 2015 to 2023 after previously leading the country as a military head of state between 1983 and 1985, was known for his stance on anti-corruption and efforts to stabilise the economy.

Further details regarding burial arrangements are expected to be released by the family in accordance

with Islamic rites.”

Born on December 17, 1942, in Daura, Katsina State, into a Fulani family, Buhari, who was the 23rd child of his father, ruled Nigeria both as a military and civilian leader.

Meanwhile, the Presidency has reacted to Buhari’s passing.

In a statement signed by Bayo Onanuga, Special Adviser to the President, Information and Strategy, President Tinubu has spoken with Mrs Aishat Buhari, the former President’s widow and offered his deep condolences.

President Tinubu has also ordered Vice President Kashim Shettima to proceed to the United Kingdom to accompany President Muhammadu Buhari’s body back to Nigeria.

Former President Buhari was twice elected Nigeria’s President in 2015 and 2023.

He also served as military head of state between January 1984 and August 1985.

President Tinubu has ordered flags at half-staff as a mark of respect for the departed leader.

Coalition: Presidential Ticket Won’t Divide ADC — Momodu—-Chief Dele Momodu, the publisher of Ovation magazine, has stated that opposition politicians who have taken over the African Democratic Congress (ADC) have agreed in principle that internal struggles for power will not destroy the coalition.

Momodu, while speaking on Arise Television’s Prime Time on Wednesday, expressed delight at the launch of the coalition, saying the opposition politicians in ADC are ready to unseat President Bola Tinubu and the ruling All Progressives Congress (APC).

The launch of the coalition led by former Vice President, Atiku Abubakar, was attended by many top politicians including the 2023 Presidential candidate of the Labour Peter Obi, former Governor of Osun State, Rauf Aregbesola, Former Senate President, David Mark, former National Chairman of the ruling APC, John Odigie-Oyegun, former Governor of Kaduna State, Nasir El-Rufai, Abubakar Malami and former Minister of Transportation, Rotimi Amaechi.

Others include former Governor of Sokoto, Aminu Tambuwal, Yusuf Datti Baba-Ahmed, Dino Melaye, Elisha Abbo, and many other politicians who joined the coalition from the PDP, the APC and LP.

Speaking during the show, Momodu said the coalition politicians are placing Nigeria above personal interests.

Asked if the political positions had already been shared among top members of the coalition, the publisher responded negatively, adding that coalition members already knew what would likely happen, but they wouldn’t let it divide them.

“I believe that, in principle, they know what is likely to happen, and they’ve decided they’ve promised that they will not allow that to divide them, right. That for me is joyful. I’m excited,” he said.

He said some of the politicians in the ADC are not in the party to grab power.

Meanwhile, Dumebi Kachikwu, the 2023 Presidential candidate of the ADC, has kicked against the adoption of his party as a coalition platform by opposition politicians.

He described the opposition figures taking over the ADC as ‘enemies of Nigeria.’
